absolute assignment 〈英〉绝对的债权转让;绝对的权利转让 指一方当事人将自己的债权全部(而非部分)转让给他人,结果使转让人对此不享有任何权益,受让人无须与转让人联合即可单独起诉债务人。以抵押方式或信托方式进行的转让可以构成绝对转让。1873年《司法组织法》〔Judicature Act〕第25条(现已为1925年《财产法》〔Law of Property Act〕所替代)规定,合法债务或权利动产〔chose in action〕的所有人有权将其合法权利转让,但须以由转让人签字的书面方式进行绝对转让。它区别于附条件的转让〔conditional assignment〕或单纯的担保〔charge〕。
