interpleader n. 确定竞合权利诉讼 在有两人或两人以上对由第三人持有的财产提出同一权利主张时,确定该财产究应谁属的诉讼程序。即,持有某项财产但对该财产不享有任何利益者,在有两人或两人以上对该财产均提出了权利主张,而他又不知道谁是真正的权利者,且已被或将会被主张权利者起诉要求其返还财产时,为避免自己受到损害,要求他们相互之间进行诉讼,以确定真正的权利人。这种情况称之为「争议财产保管人提出的确定竞合权利诉讼」〔stakeholder’s interpleader〕。如果有第三人对行政司法官正在执行中的财产提出权利主张,行政司法官也可以申请进行确定竞合权利的诉讼,这种情况称之为「行政司法官提出的确定竞合权利诉讼」〔sheriff’s interpleader〕。该程序最初主要为衡平法上的救济方法,但现在在普通法上更容易获得。它不能作为一项权利来主张,是否授予该救济由法院自由裁量决定。其诉讼标的通常为曾经合法转让的债务、金钱、物品或权利动产〔chose in action〕。
