juristic act
juristic act 法律行为 亦写作act in the law,指当事人为达到某一法律效果〔legal effect〕或某一在法律上可能的结果而进行的意思表示或意图宣告。通过法律行为，当事人可以设立、变更或终止权利和义务，影响与他人的法律关系。法律行为可分为单方法律行为〔unilateral juristic act〕和双方法律行为〔bilateral juristic act〕，前者如遗嘱行为，后者如合同行为。法律行为还应与法律作用〔acts of the law〕相区别，后者并非指当事人的行为，而是在人的意志力外由法律本身而影响当事人的权利和义务。
