power of appointment trust

A trust in which property is left in trust for the surviving spouse.

• The trustee must distribute income to the spouse for life, and the power of appointment is given to the spouse or to his or her estate. A power-of-appointment trust is commonly used to qualify property for the marital deduction. See marital deduction under DEDUCTION.
