discretionary act DISCRETIONARY ACT, 任意性行为 discretionary act (1)任意性行为 在法律没有明确、严格的规定时，行为人可以自由决定作为、不作为以及作为的方式的行为。当法律有明确、严格的规定时，便排除行为人的任意性行为。 (2)裁量行为 法官或行政官员根据具体情况，自由决定是否作为以及作为方式的行为。除非证明行为人滥用自由裁量权，不得否认该行为的效力。也称作discretionary function。 (→discretion; abuse of discretion)
