real property 不动产 从历史角度看,在英格兰法上,「real property」是指可用物权诉讼〔real action〕予以实际返还和救济的物及在物上的权利。后因实际返还仅限于请求人持有自由保有利益的情况,如保有的是终身地产权,「real property」越来越用来指土地及土地附属物和在它们之上的权利。同时「real property」也指其它一些可以自由保有的东西,如官职、年金等,因为它们以前与土地所有权有关。另外「real property」的范围可以由制定法来规定,亦可由当事人约定。最后,还有观点认为「real property」包括土地〔land〕、保有产〔tenement〕和可继承财产〔hereditament〕,或认为「real property」是指在被继承人无遗嘱死亡时可通过不动产代管人〔real representative〕传承给其继承人的财产。(→real action; property; real representative)
