seign(i)ory n. (1)庄园;领地 (2)领有关系;保有关系 指封建领主与领有其土地的封臣之间的关系。 (3)领主权指领主〔lord〕对封臣〔tenant〕因后者保有其土地而享有的各种权利和利益,如收取地租、接受效忠、接受服务、监护权、财产复归权等。1289年以前,领主权可通过次级分封〔subinfeudation〕创制,但1289年的《封地买卖法》〔Quia Emptores〕废止了这一做法。随着封建保有附属权〔incident〕被逐渐废弃和封建租役〔rent service〕的慢慢失去价值,领主权也变得没有实际意义了,结果后来存在的领主权几乎都是附属于庄园的领主权〔seignory attached to a manor〕。依不同标准领主权可作如下划分:效忠领主权〔seignory by fealty〕和封建租役领主权〔seignory by rent service〕;最高领主权〔seignory paramount〕和中间领主权〔mesne seignory〕;附属于庄园的领主权和单纯领主权〔seignory in gross〕。在庄园转让过程中,附属的领主权也随之转让,但单纯的领主权则要有转让契据〔deed〕才能转让。 (→seigniory in gross; subinfeudation; rent service; mesne)
