accretion n. (1)土地的自然增加;(土地)添附 通常是指由于自然原因,例如通过海洋或河流的运动而逐渐地、不易察觉地导致土地的扩展。土地的自然增加分为两种:一种是通过冲积方式〔alluvion〕,即由于水力冲击泥沙并淤结而成坚固的土地;一种是由于海水下退〔dereliction〕,即当海水退落至平常水位以下时土地露出水面。在英国,土地自然增加幅度较小并且不易察觉,则增加的土地属于与其邻接的土地所有人;如果发生土地的突然急增且面积较大,则属于王室所有。 (2)继承份额的增加;遗赠份额的增加 在共同继承人或受遗赠人因拒绝、不符合条件或先于被继承人死亡从而不能获得遗产时,其他继承人或受遗赠人有权将该部分遗产添加于自己的份额之中。多见于罗马法或大陆法。 (3)财产的增加 指孳息的产生,例如因本金而生利息,或幼畜的出生。尤指信托财产中非普通收入的增加。 (→accrue; alluvion; reliction; dereliction)
