asylum n. 庇护所;庇护 指避难地或教堂庇护所。在古希腊,庙殿和祭坛不可侵犯,在神保护下的人或物不能通过暴力被由此驱走。在罗马帝国,皇帝的雕像和军团的鹰旗可以作为针对暴力行为的避难场所,特别是对那些遭受虐待的奴隶和逃犯提供庇护。根据基督教教义,庇护或避难的习俗属于教堂或教堂墓地。在现代,该词经常用来指对遭受不幸的人,尤其患有精神疾病的人给予保护和救济的机构,现在称为精神病院。国际法上,每一国家均有对其本国国民给予庇护,也有权对来自他国的难民或逃亡者予以庇护。这是基于一国的属地管辖权。因此,只要被允许进入和居留在外国领土,就获得了庇护并且可以此对抗其本国的权利要求。但许多国家都通过条约中规定的引渡条款对庇护权加以限制。在战时,中立国可以给予交战国的陆军或军舰一定期限的庇护。 (→extradition)
