liferent and fee 〈苏格兰〉终身用益权和绝对所有权 苏格兰法上的一种连续权利,前者赋予某人对某些标的物终身使用权和收益权,后者则是在终身用益权人〔liferenter〕去世后将标的物赋予另一绝对所有权人。在标的物为可继承财产时,终身用益权可以是严格意义上的用益权。终身用益权人实际占有标的物,可以收取租金或其他利益,但不得作永久性损害标的物价值之事。在其去世后,标的物传给绝对所有权人〔fiar〕。在标的物为动产和混合财产〔mixed estate〕,且当前越来越趋向包括不动产时,终身用益权常仅是非严格意义上的用益权,此时标的物将交付信托管理,由受托人保证用益权人的使用权和收益权,和绝对所有权人的相应权利。受托人应尽量平衡两权利人间的利益,在收入和资金之间分摊责任和费用。
