base fee (1)(英格兰古法)农奴地产权;不自由地产权 不属于自由保有地产权〔freehold〕,其保有条件也非自由的役务或军役〔free or military service〕,保有人只是依领主的意志履行役务从而保有其地产。(=base estate) (2)附条件地产权;附条件财产权 其成就和存在以其它条件的存在为前提,并在该条件终结时终结的地产权或权利。 (3)附条件或期限的自由继承地产权 这种地产权由限嗣继承地产保有人〔tenant in tail〕通过阻却其有继承权之子嗣〔issue in tail〕的权利而将原地产转化为自由继承地产的方式产生,它虽然可以对抗原限嗣继承地产保有人的子嗣,却无法对抗剩余地产权人〔remainderman〕或回复地产权人〔reversioner〕,因此在上述子嗣死亡或后二者权利成就时,这种地产权即告终结,故称附条件或附期限的权利。另外,在这种地产权与剩余地产权或回复地产权相融合时,它便扩充为一种绝对的自由继承地产权〔fee simple absolute〕。(→fine; recovery; remainder; reversion)
