n. 概念论;概念法学 亦称「jurisprudence of concepts」，指重点关注法律概念和术语的一种做法。它认为，由于该词好像在所有上下文中都有固定不变的意思，因此在判定某一特殊案件所应适用的法律时，使用三段论的推理方法即可解决问题。概念论是有缺陷的，因为法律概念和术语都是用英语单词来表达的，事实上并无固定的和确定的定义，同时，概念论也会导致错误的结论，或者阻碍在不同的上下文中对有关法律规则的理解。
