part payment 部分支付；部分偿付 指买受人将金钱或其他有价值之物交付出卖人并为其接受，而买受人的交付并不足以清偿其所欠的全部款额。债务的部分偿付可使已因超过诉讼时效而不得请求偿付的债务(实指未偿付之债务)恢复效力〔revive a debt〕。英国1939年《诉讼时傚法》〔Limitation Act〕即作如是规定。另据该法，连带债务人〔joint debtor〕之一方在诉讼时效届满后对债务所作的部分偿付，并不使其他连带债务人的债务恢复效力。根据英国1893年《货物买卖法》〔Sale of Goods Act〕，对超过10英镑的货物买卖提起可强制执行的合同之诉时，须以书面证据或者部分支付为必要条件，但1954年《法律改革(合同强制执行)法》〔Law Reform(Enforcement of Contracts) Act〕之后，对该种合同之诉不再规定特别条件。部分支付的金额首先用于清偿到期利息。如支付的金额超过利息额，超过部分则用于清偿本金，剩余本金继续计付利息；如支付的金额少于到期利息，少付部分不得计入本金。
