executory warranty

A warranty that arises when an insured undertakes to perform some executory stipulation, such as a promise that certain acts will be done or that certain facts will continue to exist. [Cases: Insurance 3036. C.J.S. Insurance §§ 537, 542–545, 569, 629, 634, 639, 706, 720, 761–762, 771.]
