casus

casus (kay-s[schwa]s). [Latin]

1. A chance accident; an event without human intervention or fault. Cf. CULPA(1); DOLUS(1).

2. A situation actually contemplated by the legislature in enacting a statute that applies to the situation. • In this sense, the term is opposed to casus omissus. Cf. CASUS OMISSUS.
