privacy privilege

A defendant’s right not to disclose private information unless the plaintiff can show that (1) the information is directly relevant to the case, and (2) the plaintiff’s need for the information outweighs the defendant’s need for nondisclosure.

• This privilege is recognized in California but in few other jurisdictions.
