A commercial enterprise that holds itself out to the public as offering to transport freight or passengers for a fee.

• A common carrier is generally required by law to transport freight or passengers or freight, without refusal, if the approved fare or charge is paid.

common carrier 公共承运人 与合同承运人〔contract carrier〕或私营承运人〔private carrier〕相对，指为一般公众在特定地点之间有偿运送货物或旅客的人。按照惯例，公共承运人对所运货物的损失承担绝对责任〔absolute liability〕，除非该损失是由于托运人的行为或过错、敌国的行为或货物本身的缺陷造成的。从事旅客运输的公共承运人〔common carrier of passengers〕仅承担过失责任。
