assault with intent to (commit) rape 蓄意强奸的攻击未遂 指具有强奸受害人意图的攻击未遂。构成这一犯罪必须具备两个基本要件，而且有证据证明达到排除合理怀疑的程度：１有企图伤害行为；２有实施强奸的故意，它不仅要求被告人有与被侵犯的妇女进行违背该妇女意愿的性交的意图，而且还要求被告人确实实施了为达成其目的的一些公开行为。这一犯罪属于加重的企图伤害罪，按重罪处罚。
