〈拉〉咨审团向陪审团的转化 向巡回法庭提供信息、作证、指控犯罪嫌疑人及审查事实等的团体可以两种形式召集，一种是咨审团〔in modum assisae〕，另一种是陪审团〔in modum juratae〕，后者被称为将案件提交陪审团裁断〔fall into a jury; cadere in juratam〕。二者的区别是：在性质上，前者审判所考虑的问题仅限于令状所列的条目，对于原告主张的否定只能由咨审团通过审查原告主张事实之真实性来完成，被告无需也不能积极反驳，而在后者的情况下，被告可以进行特别答辩，举出特定事实反驳原告。在结果上，陪审团不能因为作出了错误裁断而被处罚。而咨审团则会被处以没收财产等处罚；陪审团可以作出概括裁断〔return a general verdict〕，而咨审团则不能。「jurata」是从「assisa」中发展出来的，它成为现代陪审团和古代咨审团的连接点。 (→assize; jury)
