cohabitation (koh-hab-[schwa]-tay-sh[schwa]n), n. The fact or state of living together, esp. as partners in life, usu. with the suggestion of sexual relations. [Cases: Marriage 13, 22. C.J.S. illicit cohabitation.

1. The offense committed by an unmarried man and woman who live together as husband and wife and engage in sexual intercourse. • This offense, where it still exists, is seldom prosecuted.

2. The condition of a man and a woman who are not married to one another and live together in circumstances that make the arrangement questionable on grounds of social propriety, though not necessarily illegal.
