A covenant that imposes a duty that depends on the other party’s prior performance.

• Until the performance, the other party does not have to perform. Cf. concurrent covenant; independent covenant.

dependent covenant 附条件合同条款；在先履行合同条款 合同条款可以分为三种：在先履行合同条款、同时履行合同条款〔concurrent covenant〕与独立合同条款〔independent covenant〕。其中，在先履行合同条款是指依赖于某一在先履行的行为或条件的合同条款，并且，除非条件成就，对方当事人在由该合同条款提起的诉讼中不承担任何责任。 (→concurrent covenants；independent covenant)
