equitable title

A title that indicates a beneficial interest in property and that gives the holder the right to acquire formal legal title.

• Before the Statute of Uses (1536), an equitable title was enforceable only in a court of chancery, not of law. Cf. legal title. [Cases: Vendor and Purchaser 54. C.J.S. Vendor and Purchaser §§ 145–146.]
