false verdict false verdict, 不当裁断, 谬误裁断 false verdict 不当裁断；谬误裁断 指陪审团用抽签或掷骰子等方法而不是依据对证据的分析、评议和法官指示作出的带有偶然性的裁断。在早期英国，陪审团作出了谬误裁断属犯罪行为，受害当事人可申请签发陪审查问令状〔writ of attaint〕，以撤销原裁断并惩罚陪审团。后该令状的使用被撤销裁断并重新审理案件的做法所取代。1825年《郡陪审团法》〔County Juries Act〕将之完全废除。(→attaint)
