illusory appointment illusory appointment, 虚假处分 illusory appointment 〈英〉虚假处分 指对处分权〔power of appointment〕下的财产进行名义上的、附加限制或附加条件的处分。依照先前的规定，违背非经创设处分权的法律文件之特别授权即不得为独占性处分〔exclusive appointment〕的规则，将名义上的财产份额处分给权利人中的一个，则该处分行为在衡平法上是虚假并无效的。但这一规则在英格兰已经废除。 (→Illusory Appointment Act；power of appointment)
