nonsuit 诉讼驳回 当原告人不能使其诉讼的法定诉因成立,不能以任何可接受的证据支持他的诉讼时,或被告要求诉讼驳回,法官因此可下令终结该诉讼。此术语现主要在口语中用。

non(-)suit n. 终结诉讼;驳回诉讼 指法庭由于原告未能提出合法的诉讼理由,或未能提出足以支持其诉讼主张的证据而在不裁决案件实体问题的情况下宣布诉讼终止。在英格兰,1875年之前这一做法只适用于普通法法院,其优点在于原告能通过支付全部诉讼费用而取得终结诉讼的判决之后,可凭同一诉讼理由对被告再次提起诉讼。严格而言,现在这一做法在高等法院已不存在,nonsuit一词现在仅在口头上泛指法官从陪审团处撤回案件并指示陪审团作出有利于被告的裁定。在美国的民事诉讼程序中,该词与「驳回诉讼」〔dismissal〕一词同义。驳回诉讼的判决〔judgment of nonsuit〕分「原告自愿的」〔voluntary〕和「非原告自愿的」〔involuntary〕二种。前者指原告自行撤诉并同意法院作出对其不利的判决和负担诉讼费用。后者表示由于原告经传唤而拒不出庭、或怠于进行诉讼程序、或无充分的诉讼理由、或不能举出陪审团作出裁断所需的证据等原因而由法庭主动或应被告请求驳回其诉讼,从而终止诉讼程序。
