patent n. (1)专利(权) 指就一项发明创造而由国家授予的一定期限的垄断权。基于国家授予的专利证书〔letters patent〕,专利权人在专利保护期内享有对该发明的专有权利,并得排除他人对该发明进行制造、使用或销售等。在理论上,一般认为专利制度是发明人与政府之间的一种交易〔bargain〕,即由发明人将其发明创造向社会公开披露而换取政府授予其特定期限内排除他人制造、使用、销售其发明的专有权利。一方面,它可以「促进实用技术的进步」(美国宪法第一条第八款第(八)项,即「专利与版权条款」〔Patent and Copyright Clause〕语);另一方面,它是一种有限的垄断,专利保护期满后,任何人均得无偿使用该发明。现代专利制度起源于英国伊丽莎白与詹姆斯一世时代〔Elizabeth and James I〕,1623年英国的《垄断法》〔Statute of Monopolies〕宣布,所有授予的垄断权均属无效,但对发明例外,第一个发明人可被授予最长达14年的独家制造新工业品的特权。美国的专利法最初曾由各州规定,后根据前述美国宪法之授权,国会于1790年制定第一部美国专利法。英、美诸国专利法在长期发展中均历经多次修正,日趋完善。在英、美国家,一项发明被授予专利须符合专利法规定的条件。美国专利法规定的条件是,该发明必须具备新颖性〔novelty〕、非显而易见性〔nonobviousness〕与实用性〔utility〕;英国专利法与此基本相同,要求该发明必须是新颖的〔new〕、涉及发明性步骤〔involves an inventive step〕与适于工业应用〔industrial application〕。同时,发明人还须依照法定程序向专利机关(英国为专利局〔Patent Office〕、美国则于1975年更名为专利商标局〔Patent and Trademark Office〕)提出专利申请〔patent application〕,提交相关的法律文件,尤其必须包括说明书〔specification〕与权利要求书〔claims〕。专利申请如经审查批准,则其专利权获得法律保护,发明专利的有效期为20年(在英国,专利保护期20年自申请人提交完整说明书〔complete specification〕之日起算。在美国,1995年6月8日之前,一项发明专利的有效期为17年,自专利授予之日起算;在此后,亦采用20年有效期的做法,从提交专利申请之日起算)。专利作为一项权利动产〔chose in action〕,其权利人可以之进行转让、设定担保,也可以对他人许可使用〔license〕。在特定情形中,还可能产生对专利的强制许可〔compulsory license〕。他人未经许可而对有专利的发明进行制造、使用和销售的(美国于1996年1月1日之后还规定了许诺销售〔offering to sell〕与进口两种行为),则构成侵害专利权〔patent infringement〕。专利权人针对侵权行为可以采取的补救措施主要有禁制令与损害赔偿(此外,在英国还规定可以追缴利润〔an account of profits〕)。除发明专利以外,专利在美国还包括外观设计专利〔Design Patent〕与植物新品种专利〔Plant Patent〕,而在英国,对外观设计与植物新品种亦予以立法保护。 (2)特许;许可 指政府授予某项特权、权力或财产的行为。 (3)(公开)特许状;许可证(=letters patent) a.公开的;明显的 v.获得专利

patent appeal 〈美〉专利上诉 专利审查员拒绝对某一新发明的专利申请授予专利,从而作出专利和商标局〔Patent and Trademark Office〕决定时,专利申请人可以向专利上诉与牴触审查委员会〔Board of Patent Appeals and Interferences〕提出上诉。
trademark n. 商标 指产品的制造商或销售商用以表示产品来源、将其与他人的产品相区别的文字或图形标志。此为狭义的、亦是最常用的商标含义。在广义上,该词还可以泛指表示商品或服务来源的任何形式,包括产品商标、服务商标〔service marks〕、集体商标〔collective marks〕、证明商标〔certification marks〕、商号〔trade names〕和商品外观装潢〔trade dress〕。有时即以「mark」一词表示其广义。商标最初是以普通法进行保护,只要该标识与特定的个人或组织所生产、拣选或销售的商品相联系且具有显着性,则无须注册即受普通法保护。英国在1875年《商标注册法》〔Trade Marks Registration Act〕后,规定注册商标由商标法保护,未注册商标则由普通法上的假冒商品之诉〔passing off 〕进行保护。该法后为1938年《商标法》〔Trade Marks Acts〕所取代。在英国,商标注册由专利、外观设计与商标总局局长〔Comptroller-General of Patents, Designs and Trade Marks〕负责。商标注册簿分甲、乙两部,在甲部注册的商标具有独占性和可转让性,在受到侵权时可获得制定法上的救济。商标在乙部注册,则只是其权利人享有独占性使用该商标的初步证据,被告在受到侵权指控时可以其使用未导致商品来源发生混淆为由予以抗辩。在甲部注册的商标,经过7年后,则成为无可争议的〔conclusive〕商标。当然,可以在甲部注册的商标须具备法律规定的较高的显着性,诸如该商标为公司或个人的独特名称、具有独创性的词汇、未直接指示商品的特征或性质等。在美国,规定商标注册与保护的联邦制定法是1946年的《兰哈姆法》〔Lanham Act〕。商标获得联邦保护的条件是:1具有显着性;2与市场上实际销售的某一产品相联系;3已在联邦专利与商标局〔U.S. Patent and Trademark Office〕注册。
