conditional fee 附条件世袭地产 普通法中的一种地产。是指地产授予时附有一定的条件,如规定只有特定的受赠人及其亲生的直系继承人才能拥有该地产;如果是特殊的附条件世袭地产,则只有指定的受赠人及其亲生的男性直系继承人才有权拥有该地产。如受赠人去世时无此类后裔,则该地产应归还给授予人。但受赠人的直系继承人或直系男性继承人的出生即构成条件的实现,一旦所附的条件实现,就意味着受赠人所取得的世袭财产具有了绝对的性质,受让人就可以转让该地产,还可以通过重新购买的方式改变原来地产的附条件的性质。为了防止将附条件世袭财产转化为无条件世袭地产〔absolute estate〕,英国制定了《附条件赠与法》〔Statute de Donis Conditionalibus〕,从而创设了限嗣继承地产〔fee tail〕。 (→De Donis)
