non obstante veredicto 〈拉〉尽管陪审团作出了裁断；不顾陪审团的裁断 指在陪审团作出有利于一方当事人的裁断之后，法庭仍作出有利于另一方当事人的判决。或指上诉法院根据一方当事人提出的重审〔new trial〕请求，认为陪审团的裁断站不住脚，并且所有必需的证据都已呈上法庭，也可以决定推翻下级法院的判决，作出一项与陪审团裁断相反的判决〔judgment non obstante veredictio；judgment notwithstanding the verdict〕。普通法这一做法最初只是为了救济原告。即如果被告在答辩中承认原告的诉讼理由，但提出否定原告请求的事由，然而这些事由虽为陪审团所确认，但不足以驳斥原告的诉求或不足以阻却原告诉讼，则法院可以在陪审团作出有利于被告的裁断之后仍作出有利于原告的判决。而现在，由于普通法这一规则适用范围的放宽，或由于制定法的规定，法庭也可作出有利于被告的判决。
