(1)书面证词 指证人在公开法庭外，依法院命令〔commission〕或一般法律或法院诉讼规则的规定，在宣誓后对口头询问〔oral examination〕或书面质询〔written interrogatories〕问题作出回答，并作成笔录且经正式认证〔duly authentication〕后所形成的证词。书面证词可用作披露〔discovery〕的一种方式，在证人患有严重疾病或有其他原因在庭审时不能到庭作证时，或为在庭审时对证人的证言进行质疑〔impeachment〕，先前收集的证人的书面证词在符合法定条件的情况下可在庭审中作为证据使用。其与宣誓书〔affidavit〕的不同在于，收集和使用书面证词时应通知对方当事人并给予其对证人进行交叉询问的机会。该词也可以指记录有此种证人证词的经过认证的文件〔certified document〕。 (2)收集书面证词的听审〔hearing〕 (3)(教会法)废黜圣职 指神职人员被罢免其圣职的一种教会惩罚，宗教改革后，逐渐代替革除神职〔degradation〕而被广泛使用。 (→degradation)
