particular estate 先行地产权 指在两个或多个具有承续性的地产权中最先的那一项地产权。如甲将自己某一土地上的终身地产权授予乙，再将乙去世之后的剩余地产权〔remainder〕授予丙，则相对于丙的剩余地产权而言，乙所享有的就是先行地产权。先行地产权实质上是可供分别享有的具有连续性的地产权中在先的那项地产权，它是一种普通法上的权利，同时也是一种即时占有地产权〔estate in possession〕，区别于剩余地产权、回复地产权〔reversion〕等期待地产权〔estate in future〕。先行地产权可以是定期地产权〔estate for years〕，终身地产权〔estate for life〕或限嗣继承地产权〔estate tail〕等，但最终地产权或后续地产权〔ultimate estate〕一般均为自由继承地产权〔estate in fee simple〕。
