(Of conduct, a position, etc.) having a reasonable basis in law and in fact. • Under the Equal Access to Justice Act, a prevailing party in a lawsuit against the government will be unable to recover its attorney’s fees if the government’s position is substantially justified. substantially justified 〈美〉实质上是正当的 指在《司法平等法》〔Equal Access to Justice Act〕的意义上，如果政府主张自己的诉讼立场在实质上是正当，则它必须证明其立场具有合理的事实和法律上的根据。依该法及其1985年的修正案，如果政府能证明其立场在实质上是正当的，则可免于承担胜诉的对方当事人的律师费，为此，它必须证明其立场不仅仅勉强合理，而是明显合理，具有良好的事实和法律根据，该根据即使不是必定正确，但也是可靠的。
