cessio bonorum 〈拉〉(罗马法) (1)财产让与 为了债权人利益,无清偿能力的债务人将其财产让与债权人。此术语被大陆法系国家普遍用于指明将要分配给债权人的破产者的财产。 (2)财产让与权 指无清偿能力的债务人可自愿将其财产交与债权人,提前履行债务,以免遭监禁和丧失公权。它是现代破产法的雏形。
