clerical error 〈英〉(文书中的)笔误；书写错误 指有关文书在书写技巧和形式上而非思想内容本身的错误。在判决书方面，指法庭书记官、律师、法官所犯的错误或遗漏，但这种错误与司法职能或自由裁量权的行使无关。对于笔误，法庭可依职权随时主动纠正，当事人亦可申请其纠正。在议会制定法方面，对于法律中的笔误通常用后法来加以补正。

An error resulting from a minor mistake or inadvertence, esp. in writing or copying something on the record, and not from judicial reasoning or determination. • Among the boundless examples of clerical errors are omitting an appendix from a document; typing an incorrect number; mistranscribing a word; and failing to log a call. A court
