conditional guaranty

A guaranty that requires the performance of some condition by the creditor before the guarantor will become liable. [Cases: Guaranty 42.]

conditional guaranty 附条件保证指除主债务人违约外，还取决于其他一些条件(主要是债权人的一些行为)的实现，保证人才承担责任的一种保证。这些条件包括：债权人应将债务人违约情况告知保证人；债权人应以合理的勤勉首先针对债务人用尽补救措施等。
