continuando 连续性侵权行为的主张 旧时诉讼中的一种诉讼主张,宣称其所控告的侵权行为、犯罪行为或其他不法行为从确定的某一天发生一直持续到现在,或者宣称所控告的行为在确定的一段时期内的若干不同日期或不同时间发生过。在英国1873-1875年的《司法组织法》〔Judicature Acts〕之前提起的侵权之诉〔action of trespass〕中,如果侵权行为是连续性的,则原告可在其起诉状中述明给其造成损害的侵权行为从确定的某一天发生后持续至另一日,而不需对其中每一天发生的侵权行为分别起诉,从而避免复重诉讼〔multiplicity of actions〕,这种情况称为基于连续性侵权行为提起的诉讼〔laying the action with a continuando〕。
