culprit n. 刑事被告人;犯罪人 指作出无罪答辩后候审的被告人。对该词在卷宗中首次使用见于1678年对彭布罗克伯爵〔Earl of Pembroke〕被控谋杀罪的审判中。唐纳森〔Donaldson〕认为其来源是这样的:书记官问犯人:「你有罪还是无罪 (1)」犯人答:「无罪。」书记官:「Qu’il paroit(也许可以证明如此);how will you be tried(你将如何受审) (2)」犯人答:「By God and my country.」这些话说快了,发音就会听成「Culprit, how will you be tried (3)」 布莱克斯通〔Blackstone〕认为culprit一词是取自拉丁文culpabilis(有罪的)的缩写cul和prit(公诉人已准备好证明犯人有罪)二者的结合。
