detinue
detinue n. 请求返还动产之诉 原告请求返还属其所有但被被告非法占有的动产的一种普通法上的格式诉讼。当动产的所有人将其动产交他人占有，而此后后者拒绝将该动产返还给所有人时，所有人可通过提起此种诉讼作为救济。法律上曾一度确认如果被告对动产是通过非法手段占有的，则原告不能提起这种诉讼。但是从原则上来说，被告当初以何种方式占有动产并不重要，此种诉讼存在的根据是对动产的非法占有，而非最初的取得方式。在诉讼中，原告只对自己对该动产享有所有权及被告占有该动产的事实负有证明责任。
