emancipation n. 解放 １因免受奴役或监禁而获得自由；２未成年子女从父母的控制下解放出来而获得自立。这种解放可以通过子女与父母达成明示协议来实现，也可以通过父母的默示同意而实现；依其内容可分完全的和部分的两种解放。就未成年人来说，获得解放并无固定的年龄标准。在罗马法上，主要指儿子从父权下解放出来，最初是通过拟制出卖〔imaginary sale〕的方式来实现，后被优士丁尼〔Justinian〕废除，代之以由裁判官宣布解放的简便程序。
