emergency doctrine 紧急避险原则；紧急避难原则 若一个人遇到突然发生的危险而做出本能的反应〔instinctive action〕，这时就不能如在正常情况下一样要求他必须仔细思考而后行动。因此，由此而给第三人造成损害时，只要他事先尽了适当的注意以避免这种紧急情况的发生，且在事后，他也尽了在非常情况下所能尽到的合理的谨慎和注意，他便被认为是无过失的。医生在抢救病人时，如需要本人或家属的同意而一时无法取得，亦可援用此原则，先行施治，并以此作为对人身伤害侵权之诉的有力抗辩　 。(→Good Samaritan doctrine)
