emergency doctrine 紧急避险原则;紧急避难原则 若一个人遇到突然发生的危险而做出本能的反应〔instinctive action〕,这时就不能如在正常情况下一样要求他必须仔细思考而后行动。因此,由此而给第三人造成损害时,只要他事先尽了适当的注意以避免这种紧急情况的发生,且在事后,他也尽了在非常情况下所能尽到的合理的谨慎和注意,他便被认为是无过失的。医生在抢救病人时,如需要本人或家属的同意而一时无法取得,亦可援用此原则,先行施治,并以此作为对人身伤害侵权之诉的有力抗辩  。(→Good Samaritan doctrine)
