entitlement n. 法定权利 指个人获得法律规定的金钱或利益的权利,如驾驶执照、福利等。其是对某项利益(通常是金钱的)的绝对权利,一旦符合法律要件即应立即授予,且一旦某人获得此项权利,非经公平听证不得予以剥夺。在美国,法定权利有时被作为财产权〔property〕,有时则被看作是一种自由〔liberty〕。但不管哪种情形,美国最高法院皆认为非经正当程序〔due process〕不得剥夺个人的此项权利。
