formulae (罗马法)程式;程式诉讼 由于原来适用于一切诉讼的法定诉讼〔legis actiones〕僵化的程序难以解决纠纷,遂逐步引入灵活的程式诉讼程序。原来的法定诉讼于公元前164年被废除。程式诉讼系由裁判官〔praetor〕指定审理事实的承审员〔judex〕,并告知其审理案件的有关程式(准则)。程式的四个主要部分包括:1请求的原因〔demonstratio〕,原告说明其提出要求的事实根据;2原告的请求〔intentio〕,原告提出对被告的诉讼要求;3分析裁判〔adjudicatio〕,即在某些财产争议案件中,承审员决定财产在当事人之间如何进行分配;4判决要旨〔condemnatio〕,承审员根据事实是否得到证实,决定被告应否向原告支付一定金额的货币。
