(1)禁令 (→interdict) (2)禁治产 该词用于法国民法典中,与法文语词相同,指对于心智不健全而不能管理自身利益者,应将其置于监护人的控制之下,由监护人管理其事务并发生与其本人处理事务相同的效果。该人即被称为「禁治产人」〔interdit〕,而其地位则为「禁治产」〔interdiction〕。 (3)〈苏格兰〉禁治产程序 苏格兰法的一种程序,现已废除。若某人处理事务柔弱无能从而未经其管理人〔curator〕同意不得签署任何契据的,则该人即被称为禁治产人〔interdictor〕。该人既可以通过被授予禁治产保证书〔bond of interdiction〕而自愿受此限制,亦可经由最高民事法院〔Court of Session〕的司法程序而被施以限制。
