lex loci contractus 〈拉〉契约地法 有时指契约缔结地法,有时指契约履行地法。一般来说,契约的效力由缔约地法决定,如依缔约地法是有效的,则在其他任何地方都有效;如依缔约地法无效,则在其他任何地方都无效。这一规则来源于自然公正的理念,然而任何国家都不会承认或执行对它不利的契约。在契约没有特别规定的情况下,确定契约的准据法,应选择与契约有最密切和最真实联系的法律。常简写为「lex loci」或「lex contractus」。
