pignoris capio 〈拉〉(罗马法)财产扣押;取得担保物之诉一种法定诉讼〔legis actiones〕,限于某些特定的钱财案件,指债权人不经初步诉讼或法官的参与,在证人面前为一定言词的声明,即朗诵一段规定的语句,便可取走债务人的一项财物作为质物或担保物,以迫令债务人清偿。类似于普通法上的distress。
