praecipe n. (1)(英格兰古法)指令令状 早期普通法中的一种起始令状〔original writ〕,指令被告为某种行为或对不为某种行为作出解释。此时它又被称作「writ of praecipe」。例如指令交付令状〔praecipe quod reddat〕就是指令被告将土地返还给原告,当然此令状还可用来指令被告偿债,返还其他动产或不动产;而在阻却限嗣继承的两重拟制诉讼〔common recovery〕中,这类令状就要发给接受保有人转让的限嗣继承地产而以完全保有方式持有地产者,为此他被称为指令令状针对的被告或保有人〔tenant to the praecipe〕。在早期普通法的发展中,指令令状曾因事实上剥夺了领主法庭对不动产权益诉讼的管辖权而遭到贵族的抵制。 (2)申请便函 一种书面的申请,包括当事人所请求事项的要点,它登记在即将依此申请而签发相应令状的机构,而这种相应的令状便是为了使上述申请得以实现。 (3)(书面)指令;指示 发给法庭事务官,指令他签发相应的令状以完成某种事务。
