right of termination 〈英〉终止合同的权利 亦作「right to terminate」，是合同的一种救济。指如果一方当事人违反了约定的合同义务，则法律赋予无过错一方终止合同的权利，并可以追究对方的违约责任。与之相对的是撤销合同的权利〔right to rescind〕，后者产生于一方当事人违反独立于合同的某些义务之时，但对于可能造成的损害，无过错一方不能主张违约损害赔偿，只能以欺诈等理由寻求救济。(→right to rescind)
