third party action

An action brought as part of a lawsuit already pending but distinct from the main claim, whereby a defendant sues an entity not sued by the plaintiff when that entity may be liable to the defendant for all or part of the plaintiff’s claim.

• A common example is an action for indemnity or contribution. [Cases: Parties 50. C.J.S. Parties §§ 128–131, 142, 151.]
