transferred intent

Intent that has been shifted from the originally intended wrongful act to the wrongful act actually committed.

• For example, if a person intends to kill one person but kills another, the intent may be transferred to the actual act. See TRANSFERRED-INTENT DOCTRINE. [Cases: Criminal Law 25; Homicide 555, 702, 731. C.J.S. Criminal Law § 43.]
