A remainder that is given to an ascertained person and that is not subject to a condition precedent.

• An example is “to A for life, and then to B.”

vested remainder 确定的剩余地产权 指当地产上某一权益终止时限定并转让给某人占有该地产，从而形成的一种期待权益。例如，指定某一地产由甲终身保有，而由乙对剩余地产权作自由保有，当甲死亡时，则该地产由乙(当乙死亡时则由其遗产代理人)占有，那么，乙所享有的就是确定的剩余地产权。享有确定的剩余地产权者虽然在将来才能对地产进行占有、使用与收益，但其可以像现实占有权利〔interest in possession〕人那样对其权益进行转让、处分或设定担保。它与不确定的剩余地产权〔contingent remainder〕相对。 (→remainder; contingent remainder)
