warranty against infringement

A merchant’s warranty that the goods being sold or licensed do not violate any patent, copyright, trademark, or other intellectual-property claim.

• The warranty does not arise if the buyer provides the seller with the specifications for the goods purchased. Under § 2-312(3) of the Uniform Commercial Code, the warranty against infringement is a part of the warranty of title unless it is explicitly disclaimed.
